Court Enjoins Town Council Action in Decatur
A court order blocks actions by the Decatur town council after a filed complaint. The ruling halts current council measures until further judicial review determines legality and next steps for the municipal body. Local residents await clarified guidance and potential reassessment of debated ordinances.
Kirkwood Case Lets Officers Officiate While Vote Decides Schools
Judge John H. Candler ruled in DeKalb that Kirkwood exists under the act, enjoins mayor and council from duties until the town election next month, allows a town marshal and registrar to continue, and requires a two thirds vote of qualified voters to authorize purchasing school houses or establishing a public school system. The decision refines limits on council power to levy taxes for schools and upholds de facto status of the appointed marshal and registrar. The Fulton court hearing lasted five hours last Friday with a prompt written order completed Monday.
