Shoe Trust Haled to Supreme Court
Washington January 10 Officials of United Shoe Machinery faced Sherman antitrust scrutiny in the Supreme Court as the government appeals a Massachusetts ruling nullifying an indictment. Solicitor General Bullett argued the act is a criminal measure and the combine’s 70 to 80 percent market share cannot shield it from restraint of trade. Defenders Frederick P. Fish and Charles F Choate Jr argued consolidation was normal trade and that tying clauses could not be reviewed as part of the conspiracy at this stage.
