Higdon on Stand at Court Martial
Montgomery Alabama January 3 Special The feature of the Kyle court martial today was the presence of Colonel L Higdon on the stand as chief witness for the state. His direct examination proved orders and letters behind the charges and rebutted Kyle s claims of good soldierly character. The defense opened up relations with two officers and a long cross examination covered the Spanish war troubles and Higdon s resignation request. He described signing endorsements for three majors and later wiping out old scores to learn who was behind the trouble. He asserted his August 17 letter was official and legally authorized to write such letters to officers in or out of service. He admitted authorizing Captain Hughes Kennedy to act as agent in the campaign and to beat the other man if possible. Kyle s defense is developing a theory that he was in New York during the encampment and there was no camp order to inspect companies. The crucial issue remains whether the correspondence is official. An appeal to civil courts has been secured as a reserve. The court holds two sessions daily with a night session devoted to Kyle s witnesses. Captain Robert E Simpson testified Higdon offered him trading influence to withdraw opposition. Lieutenant T W West testified Higdon secured his promise to vote for Captain Harrison and that they consulted the judge advocate about ousting Kyle for missing camp. The defense seeks to show a Higdon plot to force Kyle out to complete a trade.

Jackson Mississippi January 3 Special It is learned that unless a freight rate reduction is promised at the meeting next Tuesday the Mississippi railroad commission will direct Attorney General McClurg to institute legal proceedings to set aside the consolidation of the Southern railway and the Mobile and Ohio which occurred last year A majority of commission members have expressed themselves They have been goaded to action by complaints of wholesalers and shippers about excessive freight rate schedules At the time of consolidation McClurg favored a suit to set it aside arguing it violated the state constitution which forbids combining competing lines The railroads influenced other state officials to drop the matter and it has been quiet until new complaints arose
