Federal Judge Rules on Central Georgia Rate Case
Judge Newman in the United States District Court filed a decree in the Central of Georgia vs Georgia Railroad Commission case. He declined to name Governor Smith as a party and ordered a six month test of the 2.5 cent rate to see its effect on passenger receipts while preserving the possibility of an injunction if losses occur. The judge stressed time as decisive and warned against treating the suit as state action under the eleventh amendment, citing the Reagan case as governing.
