Zadoc Smith Heirs Compete Over Cobb County Lineage
Macon Ga April 18 Special By 2 United States census records of 1856 introduced in court the Zadoc Smith heirs contest claims by Cobb county heirs that James M Smith was son of William and Lucinda Smith and disappeared at 18. Census returns show no such William and Lucinda in Cobb but Pike county records place them with a son James W Smith. Evidence also linked James M Smith to Zadoc Smith’s Wilkes county home in 1850 and noted illegitimate Pick Smith in Haber sham county. Further testimony supported James M Smith as legitimate son of Zadoc and Phoebe Mabry Smith. The Louisiana heirs’ claim that tombstones and short biographical notes prove an alleged illegitimate birth were denied by a marble dealer affidavit and by J W Reed of Athens who authored Men of Mark.
