In response an attorney representing the Bill of rights committee which proposed the charter to give local authority Over tracking issues requested that the elections Board file its findings with the court. A we intend to intervene and provide evidence and Legal authority to the court in support of the Validity of the petition a wrote attorney Terry Lodge in the letter to the elections Board. Although the petition contained the required number of signatures the elections Board found that the proposed charter is invalid because it does not structurally change the form of government in Athens county. A we believe the boards conclusion. Is not supported by Law and is arbitrary a Lodge wrote. Under a Section of Ohio Law cited by Lodge the elections Board had to take the matter to common pleas court within three Days after it was requested by the Bill of rights committee. The elections Board received lodges letter on Friday. Penny Brooks Deputy director of the elections Board said the Board of elections has scheduled a meeting for monday at 9 30 . To consider the matter. County assistant prosecutor John Haseley said that after reviewing the Law on the Issue it is his opinion that the record of the boards earlier decision should be certified to common pleas court a similar to How some election issues Are appealed to the Ohio Secretary of state. The proposed charter states that it would be illegal to use Athens county As a disposal site for frack water and other byproducts of High volume horizontal Hydraulic fracturing commonly referred to As tracking. It also states that it would be illegal to use water from Athens county for High volume tracking to extract shale Gas and Oil. County prosecutor Keller Blackburn in a letter to the elections Board on monday said the does not believe the proposed charter if enacted would allow the county commissioners to make sweeping changes concerning horizontal drilling or injection Wells. Blackburn said in his opinion the proposed charter would not structurally change the form of government in Athens county. However Blackburn had recommended monday that the elections Board approve it for the ballot unless the Ohio attorney general confirms that the proposal is not charter. The Medina county Board of elections had received a similarly worded charter proposal.
