Appeal Over Costs In Wellington District Court Case

In Wellington on Monday Mr Justice Cooper heard an appeal arising from a District Court assault case at the Masterton Show Ground. Sergeant Miller sued farmer J J Kennedy for £200 damages after being removed from a coat during a football match. The jury awarded £5 to Kennedy and the district judge ordered costs. The sergeant appealed, claiming no certificate of approbation under the Police Force Act had been issued. The judge set aside costs and directed the district judge to decide on the merits an application for a certificate under Section 16 of the Police Force Act.
