Court rules brain dead child counts as dead for murder case
In St Paul a district court judge ruled the 4 year old victim in a brain death case is legally dead for prosecuting the mother Denise M Ellison. The mother, 24, entered not guilty pleas and is scheduled for trial August 14 after a mental evaluation. She faces third degree murder and aggravated assault charges. A separate hearing at Children's Hospital on a respirator disconnection is set for July 6. The judge called the session 38 minutes long.
