District Judge Lucius Babcock sentenced Henry Lovett a Chickasaw to death for the fatal shooting of Dee Foliart a high school coach during a bank robbery attempt at the First National Bank in El Reno Oklahoma. The date of execution was set for April 17 and Lovett’s attorney James Mather filed an appeal.

The Texas House approved a bill by Rep. Petsch of Fredericksburg making kidnapping for robbery ransom or extortion a capital offense with a minimum five year term in the penitentiary The measure totals 112 to 5 in favor and tabled an amendment to remove the death penalty Venue would be set by the county where the offense occurred or where the victim was held or taken It was enacted as an emergency measure to address gaps in kidnapping law and deter kidnappers.
The jury found C C Guthrie not guilty of embezzling 196.13 from the San Jacinto Baptist Church where he served as treasurer in 1930. Judge Henry Bishop presided in the criminal district court.
Two University of Kansas students E. E. Tate and George Tooley Jr., both 22, were arrested near Olath while returning to campus with suitcases packed with bottles. They stayed in jail to inform parents, saying they were earning their way through college. Parents called them model sons and planned to post a $1,000 bond each for their release.
A squadron of 30 planes from Kelly Field headed out from El Paso to search for Cadet Earl Donnelly missing since yesterday after leaving Fort Sill Oklahoma. Three groups aimed for Lubbock Clovis New Mexico and toward Seagraves and Midland.

Emmett Thompson faces two hours of cross examination in Vernon Texas over the November death of his Gray county partner Homer Crabtree. The defense disputes Thompson's statements about truck drivers near LeFors while the state seeks to use his separate trial bid to place Hefner as a material witness. A ruling on the application was awaited after lunch.
Charges of robbery with firearms were filed in Pampa Texas early today against Roy McGee and Roy Stephenson after they were identified in connection with the First State Bank of Alameed robbery. Customer Jim Bryant was wounded. about $2,110.65 was recovered from a house in the oil field south of Pampa.
Amarillo and vicinity expect light rain tonight with Friday partly cloudy skies. West Texas shows cloudy conditions with local rains tonight and Friday, rain eastern portions. New Mexico unsettled tonight and Friday with snow in northwest and north central areas. Temperatures will stay near 62 to 44 degrees.
An earth tremor of decided intensity rocked Albuquerque late last night marking the third tremor in recent months. Police reports say hospital patients were shaken from beds and several movie theaters averted near panics as lights stayed on and shows continued.
About 155 American broadcast stations will carry Pope Pius XI’s February 12 address. Arrangements aim to include all units of the National and Columbia chains in the Vatican City rebroadcast inaugurating the new short wave station. NBC network will total 74 stations plus three extra transmitters.
Mrs. Cecil Taylor was acquitted of murder in the shooting of her husband, a former San Angelo auto dealer, after a 12 minute jury deliberation. She testified she fired in self defense to protect her children as Taylor forced entry after a separation. The incident occurred Sept. 1, 1930 at the Jacoby ranch home.

An entire family of six perished in a blaze that leveled their Asco home near Welcit. Mrs. Clarence Bennett 23 died in a hospital the night of the fire which also killed her husband and two sons ages 4 and 6. Daughters 7 and a baby girl died the next day.
Hawkes Bay area reports nearly 200 bodies recovered after the February earthquake. Fifty were buried, the rest in a common grave with a combined religious service for the unidentified dead. American casualties not listed yet. A tremor rocked Hastings, declaring martial law and restricting access to the business district.
Sen. W. K. Hopkins of Gonzales offers a Hopkins bill to the Texas legislature. It aims to return to convention nomination for U S senate and statewide offices with safeguards to prevent abuses that led to abandoning the convention plan.
The Texas prison board's annual report shows net operating cost for the year ending December 31 at 870,445.20 dollars, down from 1,142,625.00 the prior year. Chairman W. A. Paddock attributes much of the decrease to the rise in cotton production and sales, noting 10,709 bales sold for 726,564.99 dollars versus 2,046 bales for 297,700.04 dollars in 1929. Escapes also declined.
Washington February 5 Chairman Legge of the farm board declares a wheat shortage entirely possible if the drouth continues. He cites last year’s carryover at 40 percent of normal as a contributing factor and notes the drought has affected the Midwest but it is too early to gauge full impact. See WHEAT Page 2.

Washington February 5 The Senate Commerce Committee approved the Capper bill by a 9 to 6 vote to restrict foreign oil imports. The measure would limit crude petroleum imports to 16 million barrels annually for three years, with a ban on refined products and by products for the same period.
The Tri State Fair association voted to offer student tickets for the German Grand Opera season in Amarillo at 1.50 on main floor and 1 in balcony to promote education and culture. Repertoire includes Die Walkuere The Flying Dutchman and Tristan und Isolde with Ben H Atwell and James Wathan presenting explanations to students.
