Judge rejects $33 million Bank of America bonus settlement
U S District Judge Jed Rakoff called the proposed consent judgment inadequate and said the 33 million penalty was trivial for a false statement affecting the Merrill Lynch merger. He set a February 1 trial date as the SEC had charged Bank of America with misleading shareholders about bonuses. Charlotte based Bank of America had agreed to acquire Merrill in a shotgun deal during the credit crisis, with $3.6 billion in bonuses accelerated before closing. Neither firm commented on the ruling.
