In Wagener, no county ordinance blocks an outdoor 5,000 seat amphitheater near a cemetery. The concert site lies under a tenth of a mile from the cemetery. officials say only a public nuisance statute could apply after opening. Construction is halted while engineering plans await county inspection approvals. Citizens have signed petitions opposing the project.
