Washington appeals court tosses case over teacher student sex
A Washington Court of Appeals panel ruled 3 to 0 that charges against Matthew Hirschfelder, a Hoquiam High School choir teacher, could be dismissed since the student was 18 at the time. The decision rests on the claim that state law targets minors ages 16 and 17, not 18. The ruling leaves the state code of professional conduct for teachers in force, with teachers risking dismissal for any sexual contact with pupils regardless of age. Hirschfelder has not taught since 2006 and was briefly on administrative leave. his case did not proceed to trial.
