Settling the matter, the court kept the second degree burglary charge and issued warrants for the remaining defendants.

Deputy U S Marshal Alien Stanfield raided a distillery and storeroom east of Lehigh in Coal county. John Voto was arrested on charges of operating a distillery without a license and possessing untaxed whiskey wine and beer. Officers seized 34 gallons untaxed whiskey 40 gallons grape wine 144 quarts of Choctaw beer 7 sacks barley malt and multiple kegs and barrels, then destroyed the inventory and equipment. The raid was conducted alone by Stanfield who found the haul hidden in Voto's grocery store garage and barn.
