Oklahoma City Aug 6 Attorney General Edwin Dabney said a district judge cannot sentence a prisoner to five years and suspend four for release after one year. The opinion notes such a suspended sentence is effectively parole and only the governor can grant it. It may require S N Love to serve the full five years for auto larceny, as the judge had tried partial suspension. The statute allows suspending an entire sentence only for first offenses by minors. The youth would report to the court if this applied.
