End of Hatzic Company Litigation in Victoria Court of Appeal
After a two day hearing in Victoria the Court of Appeal dismissed the appeal of L Scott Whiott and Messrs Buttar and Chileno liquidators of the H P Co against Chief Justice Hunter who granted the creditors petition led by M L Kenworthy for dismissal of the liquidators. The Court of Appeal unanimously upheld the Chief Justice’s decision. The appeal contended incompetence in handing over liquidation to the British North America Co and imprudent bargains increased liabilities. Scott Elliott and liquidators were to pay notes. Counsel lists for creditors and appellants follow.
