In a heated session on January the House discussed renewing the sedition law. Representatives argued constitutional validity, expediency, and the impact on free speech while detailing past prosecutions and the law’s effects.
On Monday February 6 1801 the motion by Mr Bayard to Rutledge Nicholas Griswold Macon Bayard Taliaferro Foster Claiborne Oxley Davis Morris Champlin Baer Cooper Line and Wood was referred. It resolves that if equal votes occur for two persons the House shall proceed to choose a President by ballot and continue daily until a majority is reached.
The passage outlines procedures for selecting a President as March next, detailing that no person may have a constitutional majority, that the Speaker and members of the House shall proceed to the Senate, and that after initial balloting the House continues voting until a President is chosen.
