North Dakota Proposal to Amend Constitution Remission Powers

The Fifth Legislative Assembly proposes an amendment to Article 76 granting the governor, with the attorney general and chief justice plus two appointed electors, authority to remit fines forfeitures grant reprieves and pardons for all offenses except treason and impeachment cases. The legislative assembly may regulate remission procedures. treason cases allow suspended execution and possible further action by the assembly. The governor must report each remission or pardon to the legislature with convict details and dates.

Amendment to North Dakota constitution on railroad and carrier taxation

A proposed fifth assembly amendment would amend section 17 to require all railroad property and the franchises of express freight and passenger carriers, telegraph and telephone companies to be assessed by the state board of equalization at actual value. The assessment would be apportioned to counties and districts where operated, with roadway portions used for nonrailroad purposes taxed as real property. The amendment awaits submission to voters at the next general election.
