Overpaid incomes taxes returnable under community rule
Washington, Dec. 7. The Bureau of Internal Revenue issued an opinion on community income of husband and wife in Texas cases that will apply to other states. It allows half of the community income to represent each spouse, reducing surtax. For past years, amended separate returns are needed with wife paying tax on her return and husband filing for abatement credit or refund. The latest ruling credits husband’s overpayments against the wife’s tax and permits a net overpayment claim. Substantial Texas tax payments are involved.
