Supreme Court Rules Partnership Property Must Pay Firm Debts
The court held that when a partnership buys land with partnership money and deeds it to partners as tenants in common the property is held in trust for partnership creditors. On insolvency individual partners cannot sell their interest to pay personal debts without causing a breach of partnership duties. Partners and creditors are protected as the partnership assets should satisfy partnership debts first.
