District court convened with no sitting judge. E A Rea elected judge pro tem. In State vs Hazen the defendant objected to trial before a pro tem, arguing a U S government position by J C Ruppenthal created a vacancy in the 23rd judicial district. The pro tem ruled the defendant could be tried, but recessed to seek Supreme Court clarity on vacancy and appointment by the governor if the office is vacant.

James Clellan Buchanan born October 4 1839 in Park County Indiana died September 14 1918 at his home in Good Hope Illinois after a five week illness from kidney trouble He was 78 years 11 months and 10 days He served in the Civil War and held church offices in Cumberland Presbyterian and Presbyterian congregations He married Sara Elizah Singletary in 1865 and later Emily T He lived in Kansas before moving to Good Hope in 1912 The funeral was at Ogallah with Masonic rites Burial followed beside his first wife
