Government Wins Second Great Victory in Tobacco Trust Case
The Supreme Court ruled the American Tobacco Company and its subsidiaries and affiliates, including English entities, formed an illegal restraint of interstate commerce under the Sherman Act. It ordered dissolution efforts and potential receivership, with six months to disintegrate, and directed lower courts to craft a plan in harmony with the law. The decision labeled the case a major anti trust action second to the Standard Oil case, and outlined steps to unwind the complex corporate structure built since 1890 through a series of mergers and acquisitions.
