Older Iowa lawyers protest slurs in supreme court files
Des Moines May 16. Older practitioners demand libelous matter not be included in state supreme court records in the Gooney vs. Touby case from Buchanan county. B. E. Hasner and John J. Ney argue that insulting statements in a legal context constitute libel and must be remediated, citing Ney’s history as a judge and questioning the use of terms like scurrilous in the opposing brief. The dispute centers on whether such remarks belong in official court records and how history is portrayed within the argument.
