Mortgage topic of argument in liquor car gage
An unusual set of facts emerged in district court before Judge Wood regarding chattel mortgages on a new Essex car seized with a cargo of alcohol after a 35 mile chase by Road Patrolman Mason. Frank Law of Mason City, once Cerro Gordo deputy, owned the car bought from Lapiner Motor on April 10. A $716.14 lien to the seller existed. Law was arrested April 11 after abandoning the car. The mortgage was mailed then but recorded after seizure. The legislature had rescinded a proviso on lien recording in liquor car cases, prompting questions. The seller claimed no knowledge of illegal use. The judge anticipated potential forfeiture but asked for authorities references. the car may be returned upon storage and costs.
