Clerk Guarantor: Court Cash on Hand Question in Iowa Supreme Court
The Iowa Supreme Court will hear an appeal from Allamakee County over whether a clerk of courts is guarantor of funds in hand. Arthur A. Zimmerman represents Prudential Insurance. A $790 mortgage redemption check by clerk William F. Shafer at First National Bank of Waukon was not cleared after the bank closed. Foreclosure involved farm owner William S. Hart, with Hart now Shafer’s counsel. Trial judge W U Eichendorf ruled for the defendant. If Zimmerman wins, clerks of courts may insure all funds in their custody.
