Davenport Name for Cigars Held Not Exclusive
Des Moines reports the Iowa Supreme Court ruled Davenport as a geographic identifier cannot be exclusively owned by one Davenport cigar firm. The Harkert Cigar Co sued Louis Herman to stop use of the name, while Herman argued a prior 1886 use. Justice Evans affirmed the lower court, stating both parties share rights to the geographic name.
