County seeks highway contract approval from state commission
A county cites that bids were legally opened and contracts set by the board of supervisors and asserts the state highway commission cannot arbitrarily refuse approval if the contract complies with law and specifications. The lawyer argues the commission holds discretionary power to reject excessive price or noncompliance, but abuse of discretion would allow compelled approval when the contract follows the law.
