Commissioners Rule on Butter Adulteration and Tax Liability
The ruling states butter with over 16 percent water is adulterated or processed and subject to a special tax. If creameries sell to dealers or commission merchants the manufacturer is liable, not the dealer, unless ownership transfers to the dealer at the start. In direct purchases the dealer must report buyers to allow tax assignment to the manufacturer.
