Insurance Firm Wins Opinion On Insurance License Rule
Justice Anderson of the District Supreme Court issued the writ mandamus compelling District Superintendent Drake to grant a license to Bates & Co to operate as insurance agents. The opinion holds that an insurance agent or broker is entitled to a license when compliant with the code, regardless of whether the company represented is licensed. The license accrues to the agent, not the company, and the superintendent’s duties are ministerial.
