Pipeline Act Case Before Supreme Court

Solicitor General Davis urged reversal of the Commerce Court ruling that the 1906 pipeline law taxes Standard Oil as a common carrier. He argued the law aimed to curb oil monopoly and that the dissolution order gave no ground to annul the act. Milburn countered that government lacks power to force private pipe owners to act as common carriers. The solicitor general warned against broad application to entities not declaring themselves as common carriers.
