Bradley Defines Status of List No 1 Creditors in Waggaman Case
Referee Andrew Y Bradley ruled the claims tied to List No 1 collateral are unsecured for voting on trustee election. The ten page opinion analyzes whether collateral notes pledged by third parties create secured claims, finding many holders lack title or proper pledge and that only direct security on the bankrupt’s property qualifies as secured for voting purposes.
