Thaw insanity commission could halt trial in court
District Attorney Jerome testified that experts believed Harry Thaw is insane and unfit to instruct his lawyer. Dr Hamilton supported the view after examining Thaw, while defense counsel contested the necessity of a lunacy commission. If a commission is appointed, trial may pause as jurors are excused and proceedings continue under court guidance.

Thaw Sanity Trial Details and Lunacy Commission Rules
The article explains that Thaw's trial may resume from the point stopped by his counsel appealing to the conscience of the court. A lunacy commission must determine if Thaw is sane and able to advise with his lawyers, with three disinterested members typically two doctors and a layman. If deemed insane, Thaw could be committed to Matteawan and later retried. if sane, the trial proceeds. The commission reports to Justice Fitzgerald, and its decision must be followed.
