Capuzaya Mining Case Skirts Grand Jury Interference
Judge Justice Stafford overruled a motion to quash the indictment of Eugene Davis of Capuzaya Mining Company. The case centered on alleged improper pressure by the district attorney to keep a grand juror away during testimony. Defense argued Assistant U.S. Attorney Adkins sought Pratt, a juror and Capuzaya director, to stay away to avoid bias. The three year statutory window influenced the ruling, with remaining questions to be resolved by a petit jury.
