Westinghouse Case Upheld Stay of Execution in Virginia Appeal

The Virginia Supreme Court of Appeals at Wytheville stayed execution and granted a writ of error in Westinghouse Electric Co. vs Washington and Old Dominion Railway. The Loudoun circuit court had awarded Westinghouse $81,652.19 for alleged delays in electrifying the Bluemont division from Alexandria to Bluemont. The railway contends it paid due amounts and seeks damages for contract breach, arguing delivery delays caused steam operation costs from July to December 1912. The case centers on whether late delivery damages are recoverable and the interplay of setoff and counterclaims. Representatives included Eppa Hunton and CE Jackson for Westinghouse. Lambert, Darlington, Nicol, and Mergdith for other parties.
