A West circuit court decision on the Union Pacific and Southern Pacific merger may not be final. Even if UP loses direct control of SP, enduring stock ties could keep the combined interests intact and allow UP to continue its Ogden to Pacific Coast route via Central Pacific. Public confidence shifts away from Supreme Court oil and tobacco rulings. The trend suggests large, fair-run firms won’t be automatically broken up by antitrust action.
