Victory for State Court Holds Federal Court Lacks Equity Jurisdiction

The U S circuit court of appeals today overruled Circuit Judge Pritchard and dismissed the equity suit by North Carolina Mining Co against the Wentfeld heirs. The court ruled a federal court has no jurisdiction where the same matter is pending in state court between the same parties. The Wentfelds, including Overton W Price and Henry Grinnell, had pursued title to a copper ore property in western North Carolina through multiple trials while Adams had conveyed it to the mining company for cancellation. The case was brought to the appeals court after state court verdicts were set aside for errors.
