Decision Affirms Franchises as Property in NY Gas Case

The United States Supreme Court reverses a lower court ruling, holding that gas company franchises are property and deserve a reasonable return. Justice Peckham, with full court concurrence, notes the consolidation valuation and tests for future rates, while addressing constitutional and practical factors such as capitalization, potential increase in franchise value, and the permissible limits of rate setting. The decision sends the case back for dismissal without prejudice, with instructions to reconsider under proper facts and standards.
