District Court of Appeals Grants New Trial in Kings Case
The District Court of Appeals yesterday vacated a $10,000 verdict for Madeline A Kings widow of John L King in a case against Capital Traction Company. It held the trial court erred in admitting an Interstate Commerce Commission regulation and that the commission lacked power to fix a higher speed limit at crossings. The court remanded for retrial on negligent operation, or appeal to the United States Supreme Court on the construction of the commerce act.
