Equitable Wins Suit In Surplus Distribution Case

In New York's Supreme Court Justice Scott sustained the demurrers by Equitable Life Assurance Society directors to Buford's suit seeking a just distribution of the society surplus. Buford claimed 1904 dividends totaled 6,001,906 with his share 13 dollars, contending 86,796,173 should have been distributed, leaving him 134. The judge allowed Buford to amend within twenty days, ruling policy terms grant participation but do not fix rate or extent, and that no statute or charter compels only a legal reserve amount for surplus.
