Validity of Occoquan transfer questioned
Justice Siddons in circuit court directed authorities at District jail and the workhouse at Occoquan to produce Mrs Annette Applegate wife of Chauncey H Applegate for examination on habeas corpus to determine the transfer validity from jail to Occoquan for hard labor. Her arrest with husband on prohibition charges led to an August 36 jail stay for 36 days in default of a $600 fine. Wampler, counsel, argues prisoners can be put to hard labor only after conviction of an infamous crime. police courts lack authority to commit to Occoquan or require hard labor at Occoquan or the jail. The issue has recurred since national prohibition began.
