Four Counts Against Him in Embezzlement Case
In Criminal Court No 1 Justice Wright sustained the demurrer to four of eight counts charging Thomas M Fields and Andrew A Lipscomb with about 16000 dollars embezzled from the defunct Washington Beneficial Endowment Association The court overruled the demurrer as to the remaining four counts and the defendants will stand trial unless the Court of Appeals directs otherwise Trial is set for Monday May 8 after a special appeal request from attorney D W Baker The ruling hinges on the counts wording which failed to exclude the defendants interest in the fund and to specify to whom the money belonged The judge held the receivers would be liable if they embezzled the money even if possession predated the code’s enactment
