Appellate Court Upholds Garnishment For Road Tax Debt

The Indiana appellate court ruled that a resident householder may have wages garnished up to the road tax and costs if he fails to work the road tax or pay commutation money. Hobbs, a Muncie motorman, refused road tax in Eaton and was sued by the town marshal for $2.50 tax and $18.45 costs. The court rejected his claim of exemption due to marriage and family, noting exemptions do not cover tax claims or collection costs, which can total several times the original debt.
