Supreme Court affirms Indiana employer liability act
Washington June 1 The Supreme Court of the United States sustains the Indiana state employer liability act in the Melton versus Louisville and Nashville case. Spencer Melton a Madisonville carpenter injured March 2 1905 at Ingle coal mines near Howell alleges defective tools caused a crushed spine and partial paralysis. Damages previously set at 22000 with costs and fees likely near 30000. The railroad contended the act applied only to corporations and that Melton was not a direct employee. The ruling marks the act’s first high court test and Melton’s wages were paid by the L and N at the time of the accident.
