Proposed Ordinance for City Gas and Electric Service

The ordinance authorizes operation of gas and electric plants under city supervision with first class machinery and construction. It requires the Illuminating Co to light City Hall and library without charge for 25 years, lowers gas price to 2.00 per thousand, and street lamp fees to 60 per year with possible further reductions if cheaper elsewhere. It envisions city ownership of the plant, abrogates other franchises, and states the company must bond 15,000 and guarantee continuous service, with failure to comply risking franchise forfeiture.

Washington Illuminating Franchise Granted in Washington Iowa

A special election on July 16 1898 approves an ordinance granting the Washington Illuminating Company a 25 year franchise to establish operate and maintain gas works and electric light plants in Washington Iowa. The ordinance requests first class equipment and street use rights with city supervision and sets rates duties bonds and service obligations. The city limits liability while ensuring bonded protection and a guaranteed minimal public gas and electric service from twilight to midnight.

Washington Illuminating Co Agreement in Washington Iowa 1898

Article of Agreement dated June 13 1898 at Washington Iowa between Washington Illuminating Company and the City of Washington Iowa. It sets a July 16 1898 election on a franchise to manufacture convey and sell gas and electricity with conditions including replacing gas engines with a Corliss steam engine and boilers, reducing gas output, building a new gas holder shelter within 60 days, and improving handling and housing of fuel to avoid public complaints. Attorney General Opinion on Franchise Liability for Washington Illuminating Co

Iowa Attorney General Milton Remley states that granting a city franchise to the Washington Illuminating Co. for gas and electric works does not impose city liability for company caused nuisances. The company remains liable for damages from its own acts. city may seek recovery from the company for unsafe street conditions caused by its work. The franchise does not cancel existing or future liabilities or judgments against the company.
