Antitrust Law Void As It Is Class Legislation

Judge Kohl Sant of the United States circuit court voided the 1803 Illinois antitrust act as loss and special legislation and unconstitutional. The ruling focused on the ninth clause but voided the whole act, restricting the state’s power and avoiding judicial legislative overreach. The case involved Union Sewer Pipe Co. vs Connelly and Lice, with judgments against Connelly and Dee, and appeals planned to the U.S. Circuit Court of Appeals, possibly the Supreme Court. The plaintiffs, Ohio-incorporated in 1803, alleged a pipe monopoly, while defendants argued the plaintiff was a trade restraint and violation of Sherman Act and state laws.
