Federal court overturns Negro death convictions in Louisiana
The 5th U.S. Circuit Court of Appeals reversal cites systematic exclusion of Black jurors in both the indictment and trial of Edgar Labat and Clifton Peret, who were convicted in 1953 of raping a white woman in 1950 and had sat on death row over 13 years. The ruling allows Louisiana to press new charges if a rehearing is not sought within 20 days, else the men would be transferred to Orleans Parish custody for local action.
