Mandamus Ordered For Special Railroad Election In Tippecanoe
In Kosciusko circuit court Judge Hiram S. Biggs ruled the Tippecanoe county council must grant an appropriation for a special railroad election. The council acted ministerially and could not refuse if the appropriation was properly demanded, prompting the council to convene and the commissioners to order the election. The judge noted the council overstepped its jurisdiction but praised not punishing the members for conscientious error.
