Interstate Commerce Opinion on Chicago St Paul Railroad Rates

The Interstate Commerce Commission, led by Chairman Couey, issued an opinion on the Chicago St Paul and Kansas City Railroad case. Hearing at Dubuque found Burlington Northern’s, Chicago Milwaukee and St Paul’s, and the respondent’s low short haul rates were driven by competition. The commission concluded rates must be reasonable for the public, not the companies, and could not order rate increases. It rejected using fourth section dissimilarities to justify higher short haul charges, warning against permissive tariffs giving undue advantage to certain routes.
