Gustafson Freed on Manslaughter Charge in Spirit Lake
Gustafson of Estherville was freed in Spirit Lake district court after Judge Davidson directed a verdict of not guilty on the manslaughter indictment. The case stemmed from a June 1940 crash at highways 71 and 9 near a railroad crossing that killed Millard Brown and Ralph Warner. Gustafson testified about the trip and said he swerved to avoid the truck after seeing the lights, and that he had minor injuries but continued to Estherville. The judge noted insufficient evidence of intoxication or intent and said the case involved criminal negligence rather than blame or damages. Coroner Dr. B W Jones and trooper T R Mikesch testified about the scene, with a Jackson man and others assisting at the hospital.
