In O'Brien county the Chicago Milwaukee and St Paul Railway fights a state highway law requiring abutting property to pay 25 percent of paving costs. The railway argues it should not be taxed as real estate. The county levied 2500 dollars against the road for benefits from the Iowa Pike paving. The company presented witnesses claiming damage from the paved highway as freight and passenger receipts declined significantly between Sheldon and Hartley. The railway has about 100000 dollars in similar assessments elsewhere and seeks to set a precedent.
