New Highway Law Declared Void By Attorney General
The Attorney General's Department holds that a provision on arrest authority in the new highway law is unconstitutional because it was not listed in the law's caption. Therefore, speeding motorists may still be arrested by peace officers other than county traffic officers, with the same authority as if the provision were absent. No fees may be charged by county highway officers for highway-related service.
